Applies to: the Clipping HOF Discord application, the Clipping HOF creator dashboard, and related services operated by Fixated LLC ("Fixated," "we," "us," or "our"); this policy does not apply to third-party websites, platforms, or services that maintain their own privacy policies.
Clipping HOF (that consists of our Discord server, our Discord application, and the Dashboard) (collectively, the “Services”) is a platform for a creator "clipping" program. Creators join our Discord server, accept our terms, link their social media accounts, join marketing campaigns run for brand partners, submit clips they have posted, and earn payouts based on verified view growth on those clips.
This policy explains the categories of personal information we collect, the sources from which we collect it, the purposes for which we use it, the categories of third parties to which we disclose it, how long we retain it, and the privacy rights that may be available to you. This policy describes our privacy practices and is not a contract or a request for consent except where consent is required by applicable law. If you do not agree to our Terms of Service, do not use the Services or remain in our Discord server.
When you interact with our Discord application (that is the bot that operates within this Discord server and with which users interact through commands, buttons, pop-up forms, and other options as are made available) we collect identifiers and online account information, including your Discord user ID, username, and avatar image URL, directly from you and Discord. The user ID is the primary identifier for your account with us — it is how your campaign participation, submitted clips and earnings are linked to you. Your username and avatar are used to identify you in our internal staff dashboard.
We also record which server roles you hold and which invite link you joined through. The invite link is used to credit the partner or campaign that referred you.
We record when you accepted our terms, your verification status, and whether you hold VIP or reward status. These determine which campaigns you are eligible for and at what rate you earn.
If you choose to link a social media account (TikTok, Instagram, YouTube, X) on our dashboard that we make available to you in connection with the Discord server (the “Dashboard”), we collect the account handle and publicly available profile metrics for that account, such as follower or subscriber counts and post counts; you connect through the applicable platform’s sign-in process, and we collect and store the access token issued by that platform to access information authorized by you. This is used to confirm you own the account you are submitting clips from and to determine campaign eligibility. You are not eligible to earn payment in any campaign if you choose not to link or if you unlink during the applicable time.
By linking an account, you direct us to use the applicable platform-issued access token to access and process information made available through that account as described in this policy, subject to the permissions you grant through the applicable platform and applicable law; you may revoke those permissions through the platform or unlink the account, after which we will cease using the token and delete it within a reasonable period unless retention is required by law, although doing so may affect campaign eligibility and payment as described above. Please consult the privacy policies of each respective platform for more details on how that platform uses and/or shares your data.
If you choose to link your Instagram or YouTube or other platform account through the platform’s sign-in process, we use the access token issued by the platform to retrieve an aggregated summary of your followers’ demographics. If you choose to do it, we receive an aggregated anonymized summary of your audience — such as the countries, age ranges and gender split of the people who view your content. We may disclose this aggregated or deidentified information to service providers, brand partners, campaign clients, and other third parties for campaign administration, analytics, service improvement, and other legitimate business purposes, subject to applicable law, and we will not attempt to reidentify information maintained as deidentified except as permitted by law. We may also use this to improve our own services, and will further use or disclose it as required or permitted by law.
We do not intend to receive information that identifies individual viewers, any personal identifying information, or your social media password; please do not provide such information to us. Follower demographics are retrieved directly from the platform through the permissions granted when you connect your account.
This summary is used to determine which campaigns you qualify for and which payout rate applies.
We collect the URL of each clip you submit and the public view, like and comment counts for it, refreshed over time. These figures are what your earnings are calculated from.
If you set up payouts, we collect financial and account information you provide, such as a PayPal email address or crypto payout account, legal name, business name, address, and a record of changes to it; please do not submit private keys, passwords, or other credentials. We use sensitive personal information only as reasonably necessary for payment, fraud prevention, tax administration, legal compliance, and security, apply purpose-based access and retention rules, and will implement and honor a right to limit if we use or disclose sensitive personal information for purposes outside applicable CPRA exceptions. We keep a change history because payouts must remain reconcilable for accounting and anti-fraud purposes.
If you open a support ticket, we record the messages exchanged inside that ticket channel, including any attachments, so our staff can resolve your issue and refer back to it afterwards — particularly for payout disputes, where an accurate record of what was agreed matters. If you choose to include personal identifying information, we will receive that.
We read message content only inside our designated support ticket channels. We do not intentionally access or store the content of messages you post elsewhere in the server, except where necessary to investigate abuse, protect users or the services, enforce our terms, comply with law, or where Discord or another user provides such content to us. Every other interaction with our application happens through slash commands, buttons and modals.
Personal information is stored and processed using systems operated by us and our service providers, principally in the United States, subject to vendor locations, support access, backups, and lawful transfer arrangements described below.
We may disclose personal information for the business purposes described in this policy to the following categories of recipients, subject to applicable law:
Based on our current practices and periodic operational audits, we do not knowingly sell personal information or share it for cross-context behavioral advertising, as those terms are defined by California law; we otherwise disclose personal information only as described in this policy, at your direction, with your consent, or as required or permitted by law. Recipient categories are limited to: payment processors, for processing and reconciling payouts; verification providers, for optional account or audience checks; hosting, database, security, communications, analytics, attribution, and measurement vendors, for operating, protecting, and evaluating the Services; campaign and brand partners, only for eligibility, administration, reporting, and payment relating to applicable campaigns; legal, tax, accounting, and financial advisers, for professional advice and compliance; and actual or prospective purchasers, investors, lenders, and advisers in a merger, financing, acquisition, reorganization, bankruptcy, or sale. When a recipient acts as our service provider or contractor, its written contract must impose applicable purpose limitations and privacy, confidentiality, security, deletion, retention, audit, and secondary-use restrictions; an independent recipient may use information only for the disclosed purpose and subject to its own legal obligations and privacy notice.
Our creators are based in many countries, and our systems are hosted in the United States. If you are outside the United States, using our services means any information to which you grant access is transferred to and stored there, where data protection law may differ from your own country's.
Where required by applicable law, we use appropriate safeguards for international transfers, which may include adequacy decisions, approved contractual clauses, or other lawful transfer mechanisms; you may contact us for more information about applicable safeguards.
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls for internal tools, and incident-response and breach-notification procedures designed to comply with California law. No security measure or transmission method is completely secure, and we cannot guarantee absolute security.
We retain each category of personal information only for as long as reasonably necessary for the purposes described in this policy, including providing the services, maintaining business and financial records, preventing fraud, resolving disputes, enforcing agreements, and complying with legal obligations; retention periods depend on the nature and sensitivity of the information, the purposes of processing, and applicable legal requirements. There may be technical or other operational reasons where we are unable to fully delete or de-identify your information; where this is the case, we will take reasonable measures to prevent any future processing of your information.
Support ticket transcripts may be retained after a ticket closes for support, security, fraud prevention, dispute resolution, and legal compliance, and may be deleted upon a verified request unless an exception or retention obligation applies.
The Services are intended solely for individuals who are at least 18 years old and are not directed to children. You must be at least 18 years old and meet any higher minimum age required by Discord or applicable law to use the Services; we do not knowingly collect personal information from children under 13, and if we learn that we have done so, we will take reasonable steps to delete it, except where retention is required or permitted by law.
If we make material changes, we will update the effective date and provide only the notice required by applicable law through the Services, by email, in our Discord server, or by another appropriate method; where applicable law requires consent, we will obtain it, and the revised policy will otherwise apply when posted or on the later effective date stated in the notice.
Questions, California privacy requests, or Do Not Sell/Share requests may be submitted to legal@fixated.com; please include enough information to identify your account and specify the request, but do not send passwords, private keys, government identification, or other sensitive credentials unless we specifically request them through a secure method.
