www.clippinghalloffame.com and its associated webpages (the “Properties”), are operated by Fixated LLC (“Fixated”). Throughout the Properties and in this Privacy Policy the terms “we,” “us” and “our” refer to Fixated. Fixated offers these Properties, including all information, tools and Clipping Services available from these Properties to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Where applicable law requires consent for a specific processing activity, we will provide an appropriate mechanism to obtain and, where required, withdraw that consent; otherwise, we may process your personal information on any other lawful basis available to us.
By visiting our Properties and/or contacting Fixated and/or using the features offered on these Properties, you engage in our Clipping Services, which may include, but are not limited to, emails and information submission (the “Clipping Services”). This Privacy Policy applies to all information collected by Fixated about you, regardless of how it is collected or stored, and describes (among other things) the types of information collected about you when you interact with the Clipping Services, how your information may be used, when your information may be disclosed, how you can control the use and disclosure of your information, and how your information is protected.
Fixated collects personal information and information about use of the Properties (collectively, “Information”) and, where applicable, acts as the business or controller responsible for personal information processed under this Privacy Policy. For purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, excluding information exempt from or outside the scope of applicable privacy law, including deidentified, aggregated, and publicly available information:

This Privacy Policy covers the Properties, as defined above.
This Privacy Policy applies to all Properties.
This Privacy Policy does not apply to third party websites, applications or online properties to which our Properties may link (e.g., Discord, Twitch, etc.), or which may connect to the Properties (e.g., Twitter, Twitch, etc.) and you accept Fixated is not responsible for the security or privacy practices of any such third-party websites or properties. For more information about how these third party websites, applications or online properties handle your data, we refer you to the relevant privacy policies of these organizations.
Fixated collects Information directly from you and automatically through cookies and similar technologies provided by Google Analytics and Microsoft Clarity (and similar software providers) (“Third Party Technology Providers”). As described below, we use that Information to operate, secure, analyze, and improve the Properties and to evaluate, respond to, and schedule calls requested through the Book-a-Call Form; we do not use advertising pixels or disclose personal information for cross-context behavioral advertising.
As set out in more detail in the following, Fixated may collect Information from you when you: (A) submit inquiries through for the Properties (“Book-a-Call Form”); (B) access/use our Properties; and (C) choose to receive communications on Clipping Services.
When you visit or use the Properties, Third Party Technology Providers may automatically collect information such as your IP address, device and browser information, cookie identifiers, approximate location, referring page, pages viewed, and interactions with the Properties. When you submit a Book-a-Call Form, we collect process and/or combine Information submitted thereon for our legitimate business purposes. Book-a-Call Form submissions are transmitted to the site owner by email (and expected to be retained for twelve (12) months) and are not stored in a website database.
When you visit or use our Properties, we and the Third Party Technology Providers may use cookies and similar technologies, collectively referred to as ‘Cookies.’ These Cookies assign or maintain identifiers and collect information about your browser, device, approximate location, referring page, pages viewed, session activity, and interactions with the Properties for analytics, performance measurement, and site improvement. The Properties use Third Party Technology Providers’ products such as Google Analytics to measure traffic and usage and Microsoft Clarity to understand sessions and interactions with the Properties, which may include session-replay and heatmap information. The Properties do not use advertising pixels, and the analytics Cookies described above are not used by Fixated to serve targeted advertisements. Where applicable law requires consent for analytics Cookies, we will obtain consent before placing them and provide a mechanism to withdraw that consent; you may also restrict or delete Cookies through your browser settings, although doing so may affect analytics functionality.

We may also obtain Information about you from other sources, including the Third Party Technology Providers. We may collect Information from other sources where permitted by applicable law, including where the source represents that it is authorized to provide the Information or you direct or authorize the disclosure. We do not obtain personal information about you from advertisers, data brokers, , or social media partners for purposes of the Properties.
We may receive personal data about you from other third-party companies’ products and/or Clipping Services that are used in conjunction with our Service, or whose products and/or Clipping Services may be linked to our Service. We do not use these providers to append information obtained from data brokers or advertising partners to Book-a-Call Form submissions.
We acknowledge that minors have the right to specific protection with regard to their personal information, since they may be less aware of the risks, consequences and guarantees involved. Specific protection applies, for example, to the use of minors' personal information for marketing purposes or to the preparation of personal or user profiles. The Properties are not directed to children under 13, and individuals under 13 may not use the Properties; users who are minors under applicable law may use the Properties only with the involvement and consent of a parent or legal guardian where required by law.
Fixated does not knowingly collect or store any personal information from minors under the age of consent in the jurisdiction where the minor is located without parental consent. Furthermore, Fixated does not knowingly collect or store personal information from any minors under the age of 13, from anywhere in the world. Minors under the age of 13, regardless of what jurisdiction they are located in, are prohibited from using the Properties. However, we may automatically collect limited technical information from users, including minors, solely as permitted by applicable law and as reasonably necessary to provide and secure the Properties or support our internal operations. If parents/guardians believe that we have unintentionally collected their children’s other personal information or otherwise used their children’s personal information for another purpose, they may reach out to us via the Contacting Us section below. Parents/guardians should contact Fixated immediately if they have any concerns. Please see the Contacting Us section below for further details.
You have choices over the Information provided by you and by other sources, and how that Information is used by Fixated. You can exercise your choices by (i) alerting us in response to the submission of any Book-a-Call Form, if applicable, (ii) as applicable, following the procedure described in the Contacting Us section below.
If you do not want to provide Fixated with personal information, then you can choose not to provide it. Please note that if you choose not to provide us with personal information, we may not always be able to provide you with the relevant benefits, Clipping Services, or you may not be able to access the Properties.
You may be able to control how third parties collect and share your Information by changing your preferences or opting out of collection directly with those third parties. Before disclosing Information to third parties, we recommend you check their respective privacy policies for further details.
As set out below in more detail, Fixated shares Information:
Vendors provide technological support for the Properties and Clipping Services (for example, billing, consumer Clipping Services support, consultancy, information technology hardware and software) to Fixated in order to support, operate and develop the Properties and provide benefits to users of the Properties, like you. Vendors may process your Information only as reasonably necessary to provide, secure, support, or improve services for Fixated, subject to contractual restrictions and applicable law. We do not share Information with vendors to use for their own direct marketing purposes or any other purpose other than those set out in this Privacy Policy without your consent.
We will disclose your Information in the good faith belief that we are required to do so by law, including but not limited to disclosure to law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose you, us, or our affiliates to legal liability.
This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards.
We will disclose your Information where necessary for the purpose of exercising, establishing or defending our legal rights. For example, we will review your communications and other Information in order to investigate allegations of hacking or any other breach or alleged breach of any applicable Terms of Service or this Privacy Policy and disclose your personal information, including communications, to our legal advisors, consultants and law enforcement or other government officials.
We disclose your Information to third parties where we believe this is necessary to protect the rights, property or safety of any person. For example, we disclose Information relating to an online account if we in good faith believe the user of that account is using it in ways that are harmful to others (e.g. making inappropriate contact with minors).
In connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, your Information, including communications, may be disclosed or transferred to counterparties, advisers, successors, or assigns, subject to appropriate confidentiality protections where practicable and applicable law.
Fixated takes a range of security measures designed to protect your personal information and keep it confidential (unless it is non-confidential by nature, for example, publicly-available information). We also take steps to ensure that the personal information collected is protected from misuse and alteration. In addition, we contractually require vendors that process personal information on our behalf to implement reasonable security measures appropriate to the nature of the Information and the risks presented by the processing. However, the Internet by its nature is not a secure environment and the nature of security risks is constantly evolving, as are the technical and organizational industry standards relating to management of those risks. The complete security of any personal information collected, stored or used by us or our vendors cannot therefore be guaranteed. In the event any Information under our custody and control is compromised as a result of a data security breach, we will take steps to investigate and remediate the situation and, in accordance with applicable laws and regulations, notify those individuals whose information may have been compromised.
Subject to applicable law and any available exceptions, you may request access to, correction of, or deletion of personal information by using the methods in the Contacting Us section below; we may verify your identity and authority before acting on a request.
We delete your personal information which we process for the performance of the Book-a-Call Form approximately twelve (12) months from receipt, or are earlier deleted as required by applicable law. As an exception, we will not delete your personal information where we still have a legitimate interest to use your personal information, to enforce our Terms of Service or other agreements, and/or to the extent permitted by law. For example, we may still retain your personal information to resolve disputes, enforce our Terms of Use or other user agreements, or comply with legal requirements; in this case, your personal information will be blocked from use for any other purpose. In any case, we will not retain or use your personal information longer than necessary for the purposes outlined in this Privacy Policy. Deletion from our active systems may not immediately remove copies retained temporarily in our email provider’s, or our analytics providers’ backup or security systems under their applicable retention practices.

For the avoidance of doubt, inclusion of (i)the section Disclosure to Users Outside the US and the EEA, and/or (ii) any reference to non-US residents, in this Privacy Policy in no way obligates Fixated to permit, non-US residents to participate in the Properties.
Since 2005, California Civil Code Section 1798.83 permits users of the Properties who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share users’ personal information with unaffiliated third parties for their own direct marketing purposes, without the user’s approval.
The California Consumer Privacy Act of 2018 (the “CCPA”) grants you the following rights with regard to the personal information we collect about you: (i) the right to know what personal information we have collected about you, and the purpose for which it was collected; (ii) the right to request that we delete any personal information we have collected from you (subject to certain exceptions, as outlined in the CCPA); (iii) the right to opt-out of the sale or sharing of your personal information with third-parties; and (iv) the right to non-discrimination for exercising your rights herein. We do not sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under California law; if our practices change, we will provide any notice and opt-out mechanism required by applicable law.
User Notice: We may share your personal information regarding your interaction with the Properties with third-party service providers, only to the limited extent necessary to perform Fixated’s legitimate business and operational purposes. We may share this information with third-party service providers including the Third Party Technology Providers in order to (i) optimize your use of the Properties; and (ii) assist us with further development of the Properties. The applicable service providers do not further collect, sell, or use your personal information except as necessary to perform the business purposes detailed herein. Nothing in this paragraph limits the rights of California residents under this Section 10, and our service providers are contractually restricted from retaining, using, or disclosing personal information except as permitted by applicable law and their agreements with Fixated. Where applicable law grants you and opt-out right, if you opt-out of allowing use to share your personal information to perform Fixated’s legitimate business and operational purposes, it may affect the quality of the Properties, and your ability to use all functions of the Properties.
If applicable law gives you the right to opt out of a sale or sharing of personal information, you may submit that request by emailing legal@fixated.com with the subject line “California – Do Not Sell or Share My Personal Information,” and we will process the request as required by applicable law. For more information, see the Contacting Us section above. We will be happy to honor your request.
The California Privacy Rights Act (the “CPRA”) amended and expanded the existing CCPA laws governing consumer privacy and data rights for California residents. CPRA grants special protection to California consumers’ data pertaining to government identifiers, financial account login information, precise geolocations, genetic data, biometric information, race, ethnicity, religious and/or philosophical beliefs, union memberships, content of non-public communications, and data relating to your sex life and/or sexual orientation (collectively, “Sensitive Personal Information”). In addition to the rights granted by the CCPA, the CPRA grants California residents the following rights regarding the personal information we collect: (i) the right to request that we limit our use and discloser of your Sensitive Personal Information; (ii) the right to correct any inaccurate personal information; and (iii) the right to opt-out of the sharing of your personal information with any third-party. To the extent the CCPA, as amended by the CPRA, applies to Fixated’s processing of your personal information, Fixated will honor the rights and obligations applicable to that processing, subject to statutory exceptions.
Since January 1, 2015, California Business and Professions Code Section 22581 permits you, if you are a California resident under the age of 18, to view, correct, or delete Information provided by you or publicly posted by you. You may do this by contacting us in accordance with the Contacting Us section above, and asking us to delete certain posted content.
We will be happy to review, update or remove Information and/or content as appropriate. Residual copies of Information and/or content that have been deleted may remain in our backup systems. We may still retain your Information to resolve disputes, enforce our user agreement, or comply with legal requirements; in this case, your personal information will be blocked from use for any other purpose.
If you access the Properties or submit the Book-a-Call Form from outside the United States, your Information may be transmitted to and processed in the United States and other countries where Fixated, Resend, Google, Microsoft, Vercel, or our email provider operates, subject to applicable cross-border transfer requirements.
No matter where the Information is located, Fixated takes commercially reasonable measures to safeguard your privacy rights in accordance with this Privacy Policy. If you do not agree to the collection, processing, storage and transfer of your Information, please do not provide your Information when requested and stop using our Properties.
In the United States of America, other states have passed privacy laws to protect the privacy and data of their residents. Notably, Colorado, Connecticut, Virginia, and Utah all grant protections to state residents concerning certain use of resident’s data. To the extent a U.S. state privacy law applies to Fixated’s processing of your personal information, Fixated will honor the rights and obligations applicable to that processing, subject to statutory exceptions.
The Properties do not currently respond to browser “Do Not Track” signals; Third Party Technology Providers may collect website-use information as described in this Privacy Policy unless you disable or reject their Cookies through available cookie controls or browser settings.
We reserve the right to change this Privacy Policy. We will post the revised Privacy Policy on this page and, if required by applicable law, provide additional notice or obtain consent before materially different processing begins. We advise the users of our website to regularly check this page if adjustments have been made. The effective date of this Privacy Policy is the date shown when it is posted on the Properties.
